To the Prime Minister, Minister for Foreign Affairs, Minister for Defence, Attorney General and Minister for the Arts,

We, the undersigned, call on the Australian government to take practical measures to ensure Australia’s compliance with its international obligations including pursuant to the Genocide Convention and as articulated by the International Court of Justice Advisory Opinion on the Legal Consequences Arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem.

We acknowledge and mourn the Israeli loss of life on 7 October 2023 and condemn violence against innocent civilians whoever they may be. However, this government has been hypocritically one-sided in its decision to support the disproportionate response of the Israeli government and their ongoing annihilation of Palestinian people.

In a recent media briefing IDF General Itzik Cohen told Israeli reporters that “there is no intention of allowing the residents of the northern Gaza Strip to return to their homes.” This is an official acknowledgment of the deliberate and systemic removal of the Palestinian people from Palestine, an act of ethnic cleansing and further evidence of genocide.

In light of Israel’s persistent and gross violations of international law — Including but not limited to the war crimes of intentionally using starvation of civilians as a method of warfare (see here and here) and intentionally directing attacks against the civilian population. We note that the Office of the Prosecutor of the International Criminal Court has sought arrest warrants for the Prime Minister of Israel, and former Minister of Defence of Israel, having reasonable grounds to believe that these crimes (amongst others) have been committed in Palestine.

We consider that the Australian government must:

• implement a comprehensive arms and energy embargo on Israel that covers the export, import and transfer of weapons, including parts, components, and dual-use items;
• impose targeted sanctions and travel bans on Israeli government officials, military leaders, and individuals involved in the commission of war crimes and crimes against humanity;
• take steps to prevent economic, trade or investment relations that assist in the maintenance of the illegal situation created by Israel in the Occupied Palestinian Territory;
• take steps to support the exercise of the Palestinian people of its right to self-determination, including by recognising Palestine as a State in accordance with the 2023 ALP National Platform commitments (p 140); and
• commit to executing the arrest warrants issued by the International Criminal Court for Benjamin Netanyahu, Yoav Gallant, and Mohammed Diab Ibrahim Al-Masri.

The Australian government’s refusal to acknowledge the numerous war crimes that have been committed against the Palestinian people by Israeli forces; refusal to acknowledge the tens of thousands of lives lost (mostly children); and refusal to take concrete steps to demand compliance by Israel with its legal obligations is unconscionable and contrary to Australia’s stated commitment to upholding the international rule of law.

Moreover, Australia has recently taken steps that recognise the “permanent sovereignty of the Palestinian people in the Occupied Palestinian Territory, including East Jerusalem, and of the Arab population in the occupied Syrian Golan over their natural resources.” The logical corollary of this recognition is formal acknowledgement of Palestinian statehood.

We also call on the Australian government to safeguard those who speak out against genocide, war crimes, and crimes against humanity. Arts organisations that rely on government and donor funding should be held accountable for persecuting and punishing artists and creatives that stand in solidarity with the Palestinian people

In a sector which is highly reliant on sponsorship, and where there is persistent financial insecurity for artists, threats to remove support or exclude individuals solely for having expressed an opinion has a serious chilling effect on creative freedom.

Music, art and performance have always provided a forum for free speech; “to raise awareness of injustices, provide tools for dialogue and understanding, and inspiring change”. To stifle this not only tears at our fabric of humanity but also sets a dangerous precedent of censorship in the arts.

International law and the laws of armed conflict apply to all, but they are not being enforced against all. We submit that the Australian government should not continue to support Israel in the commission of systematic violations of the most fundamental norms of international law and humanity.
